Considerations for Law Enforcement and Attorneys

Learning Objectives: Understand intellectual, learning, age, and mental health factors that influence whether someone can knowingly and intelligently waive their 5th and 6th Amendment rights. Understand when an attorney may consult with an expert to assist with assessing these factors. Learn methods that will aid in decreasing the likelihood of a suppression hearing regarding defendant statements and interviews.

Obtain an overview of the NICHD protocol for interviewing children. Apply the NICHD protocol to interviews for critique and evaluation.

Target Audience: Judges, Criminal Defense Attorneys, Mitigation Specialists, and Forensic Mental Health Evaluators

Learning Objectives: Understand basics of military command structure, training, adaptive behaviors, and potential trauma sources. Know and apply information regarding pre-military trauma and how it affects resiliency to other traumas. Understand research and applied findings regarding working with military defendants. Know how to best determine whether defendant's claims are credible. Understand how to request the needed records to aid in defense preparation.

A Primer for Legal Professionals

Target Audience: Legal Professionals

Learning Objectives: This training is a 6-hour training that prepares judges, attorneys, legal assistants, and mitigation specialists to understand the roles of treating providers versus expert consultants and expert witnesses. Guidelines and practice standards are discussed in order to provide legal professionals with the ability to critique reports, evaluations, deposition, and testimony. Attorneys will be prepared to engage in the examination and cross-examination of mental health professionals, both expert and treating providers. Judges will be able to weigh the evidence to determine whether the evidence will be considered.
